John Harper Delivers (JHD) is not a Common Carrier. By contracting JHD to carry out any work on your behalf, you The Client accept in full the Conditions set out below. These Conditions are common throughout the transport industry.
PRICES, ESTIMATES AND QUOTATIONS
The full cost of any delivery will only be assessable on completion of the job. JHD does not give or commit to any price quotations in advance of any job due to the unpredictable nature of the work, traffic and client requests. We only ever give our Hourly Rate, which may include travelling time to/from a point of collection/delivery, and fuel used for the journey.
WAITING TIME, RESCHEDULING AND CANCELLATION
When you book a job for a specified date and time, any Waiting Time will be charged from the time booked. Waiting is charged at our stated Hourly Rate. If you decide to cancel or reschedule either prior to the booked date/time or on our arrival on the time/day as agreed, we reserve the right to charge a Cancellation Fee as we will have turned down other work as a result of your booking.
The Client agrees that JHD is a Co-Insured party under the Clients Insurance Policy and agrees to Indemnify JHD against all liabilities, claims, demands, damages, losses, costs and expenses which may be brought against JHD by any party in respect of any injury to any person or loss or damage to any property arising out of or in connection with any instruction received while working on your behalf, or by any negligent act, instruction or omission by you or your agent acting on your behalf.
JHD will not be held liable for any loss or damage, consequential or otherwise, in respect of the service provided. Any goods or artwork transported on your behalf are handled entirely at your risk and you will not hold JHD liable for any loss or damage consequential or otherwise to any artwork or goods entrusted to us.
Due the fragile nature and unknown construction methods of the items we transport, the difficulty in establishing values of these items, and the non-disclosure of values of items by you the client prior to transport, we do not offer any insurance cover and you the client must ensure you have your own insurance cover arranged to cover the Conditions stated and imposed herein, including without limitations, all risks insurance at the full replacement value of any and all items or artworks transported by us on your behalf, and for the avoidance of any doubt you must maintain said insurance throughout transportation. All transportation is carried out at your risk, expense and insurance liability. In exceptional circumstances we may, at our discretion, offer compensation or reimbursement of no more than £100 in respect of any incident.
JHD will not be held liable for any delay or disruption to a delivery that is beyond our control. In the event of any delay, you the client will be solely responsible for making any alternative arrangements for the appointment of another transporter to complete the delivery of your goods. You the client will indemnify JHD against any claim or financial penalty for any unavoidable or unpredictable delay or interruption of the delivery.
No variation of these Conditions or oral stipulations or representations will be binding on JHD unless expressly agreed by us in writing.
